ANNOUNCEMENT 2001-01-03 No. 01
On the January 1, 2001, the Law on Trade Marks of the Republic of Lithuania (hereinafter referred to as the Law) came into force, which has been passed in October 10, 2000 No. VIII - 1981 (Zin., 2000, No. 92-2844).
Following this Law we are informing you that in the year of 2001 expires the determined 10 years registration validity term for the trade marks for which the applications to the State Patent Bureau (hereinafter referred to as SPB) have been presented in 1991, according to the valid legal acts of that time.
The trade marks registration has been started to publicate in 1992 in the official bulletin of the State Patent Bureau of the Republic of Lithuania "Išradimai. Pramoninis dizainas. Prekių ir paslaugų ženklai. Firmų vardai" ("Inventions. Industrial Design. Trade Marks and Service Marks. Firm Names").
According to the Art. 36 of the Law after the expire of the validity term of the trade mark registration it may be prolonged every time not longer than for the 10 years period. The owner of the mark or authorised person must submit the SPB the following documents:
1) application to prolong the term of validity of the mark registration,
2) the document confirming that the appropriate payment has been paid,
3) the authorisation for the representative in case the application is been submitted by the authorised person by the owner.
The application is printed on the form determined by SPB (form ZP-13/2001).
The payment for the prolongation of the term of validity of the mark registration must be paid on the day of submission of the application according to the sizes valid on the application submission day.
Natural persons of the foreign states not permanently residing in the Republic of Lithuania and the legal persons of the foreign states not having the representatives or branches registered in the Republic of Lithuania, present the applications and other necessary documents to the SPB only through the patent attorneys of the Republic of Lithuania (11 article of the Law).
The validity of the mark is prolonged according to the resolution of the SPB in case the following conditions are followed:
1) the application must be submitted the last year of the validity of the mark registration.
2) along with the application the document proving that the determined payment has been paid.
The owner of the mark upon payment of 50% additional payment out of the determined payment for the prolongation of the validity of the mark registration may submit the application within 6 months from the day of expire of validity of the mark registration.
The payment for the prolongation of the validity of the mark is 240 LTL since January 1, 2001.
For every more than one class of goods and (or) services for which the mark is registered the additional payment is 120 LTL per each.
Upon prolongation of the registration of the mark there are not been done any changes in the Register of the Trade marks in comparison with the last data shape of the mark registration up to the validity expiration date, except the limitation of the list of the goods and (or) services upon the prolongation of the validity of the mark only for the part of goods and (or) services.
In case the owner of the trade mark or his representative did not apply to SPB within the term determined in the Law regarding prolongation of the validity of the mark registration or did not pay the determined fee the validity of the mark is not prolonged and according to the order of Art. 24 of the Law it is registered out of the Register of the Trade Mark of the Republic of Lithuania.

The applications concerning the prolongation of the mark registration are accepted in the State Patent Bureau of the Republic of Lithuania, Kalvariju st. 3, LT - 2600 Vilnius.
